The Drama Continues

This needs to be reviewed in small pieces:

On 20 April 2015 the Texas State House of Representatives passed HB 910 with the Dutton Amendment included:

Amend HB 910 on third reading by adding the following appropriately numbered SECTION to the bill and renumbering subsequent SECTIONS of the bill accordingly: SECTION ____. Subchapter H, Chapter 411, Government Code, is amended by adding Section 411.2049 to read as follows:Sec. 411.2049. CERTAIN INVESTIGATORY STOPS AND INQUIRIES PROHIBITED. A peace officer may not make an investigatory stop or other temporary detention to inquire as to whether a person possesses a handgun license solely because the person is carrying a partially or wholly visible handgun carried in a shoulder or belt holster.

This language was removed between the first reading of the Bill and its consideration in Committee. When it went to the floor Senator Huffines got the Dutton Amendment put back in as a new amendment. The Bill passed with the above amendment.

Some people have referred to the Amendment as "stealth Constitutional Carry". I have issues with this law, but it is an acceptable stop gap until the legislature meets in 2017 and a new bill can be passed adopting true CC.

Meanwhile there is ongoing conjecture as to whether or not the Bill will have to go back to the House and possibly end up in conference committee. Theoretically enough time can be wasted this way to cause the bill to die before the Legislature adjourns sine die on 31 May. If it goes back to the House remember to bug your legislator to expedite its passage.

Concern has been expressed (or is it wishful thinking by liberals?) that Gov. Abbott will veto HB910 if it goes to him with the Dutton/Huffines Amendment included. If you are a Texan contact Mr. Abbott and politely encourage him to sign this bill. Remind him he has promised to sign both open carry and constitutional carry. Also politely remind him that signing this bill will improve his chances of reelection (be very careful not to threaten him with losing the election if he vetoes the bill, this will be taken as a challenge and guarantee a veto.).

Unless things go horribly wrong, Constitutional Carry will certainly be passed in 2017 in Texas. Two years of honest citizens showing that allowing honest folk to go heeled without licences works will certainly help its passage. Write Gov. Abbott and your legislator and express your support for HB 910 to them.

Re: Woosley letter in #818

In Issue 818, Jim Woosley asked the following question: "If someone is making bombs, and you are certain that they are not planning to clear stumps, at what point can you take action under the Zero Aggression Principle?"

Never. Pay no attention to the wobblies. Never. You never have the "right" to initiate aggression. Unless he's lobbing the bomb at you, he's not committed any aggression.

But so what? Be judged by twelve or carried by six. If you are truly a reasonable man, trust that other reasonable men standing in judgement will perceive the threat you did, and will decide your action was wrong yet justified. If you are not a reasonable man, being judged by twelve is probably for the best anyway. You become an example of how NOT to act in polite society. There are lots of possible actions short of lethality, so if that's the one you chose, you've got an uphill battle convincing others you were acting reasonably.

Shrug off the conditioning. Sometimes there is no right answer, just a whole bunch of answers with varying degrees of wrongness. This is one of those cases. Go with the action you think the least wrong and get on with your life.
